These Terms of Use (“Terms”) govern your access to and use of the TrueMCA website and any data, lists, or reports we provide (together, the “Service”). The Service is offered strictly for business-to-business use. By accessing the Service you agree to these Terms.
1. Acceptance
By accessing the Service or receiving data from TrueMCA, you agree to be bound by these Terms on behalf of yourself and the organization you represent. If you do not agree, do not use the Service.
2. The Service
TrueMCA compiles business intelligence, including indicators of financial distress, aggregated from public records and other publicly available and lawfully obtained sources. The Service identifies businesses and their principals in their commercial capacity and is intended solely for legitimate B2B sales, marketing, and underwriting activities.
3. License
Subject to these Terms, TrueMCA grants you a limited, non-exclusive, non-transferable, revocable license to use the data we deliver for your own internal business purposes. You may not resell, sublicense, redistribute, or make the data available to any third party without our prior written consent.
4. Acceptable use and your compliance obligations
You are solely responsible for how you use the data and for your compliance with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), federal and state Do-Not-Call (DNC) rules, the CAN-SPAM Act, and applicable state marketing and privacy laws. You are responsible for maintaining your own DNC scrubbing, consent records, and contact-frequency practices.
The data is not a consumer report and may not be used for any purpose regulated by the Fair Credit Reporting Act (FCRA), including decisions about a consumer’s eligibility for credit, employment, insurance, or housing. You agree not to use the Service for any unlawful, deceptive, or harassing purpose.
5. Data accuracy and disclaimer of warranties
The data is derived from third-party and public sources and is provided “as is” and “as available.” TrueMCA does not warrant that the data is accurate, complete, current, or fit for any particular purpose, and disclaims all warranties, express or implied, to the fullest extent permitted by law. You are responsible for independently verifying data before you rely on it.
6. Limitation of liability
To the maximum extent permitted by law, TrueMCA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid to TrueMCA for the data giving rise to the claim in the twelve months preceding the claim.
7. Intellectual property
The Service, including its selection, arrangement, and compilation of data, and all TrueMCA names, marks, and branding, are the property of TrueMCA and are protected by applicable law. These Terms grant you no rights in our intellectual property except the limited license described above.
8. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted to this page, and your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
9. Governing law
